Alec Baldwin (64) claims his rights. Unpleasant times ahead for the actor: after firing a shot on set that killed cinematographer Halyna Hutchins (42), the film star was charged with manslaughter and will soon have to answer in court. Before it comes to the trial, the producer now submitted an application: Alec demands a new prosecutor!

The New York Post reports that the 64-year-old’s attorneys are calling for prosecutor Andrea Reeb to resign from the case because she is a member of the state House of Representatives. “Representative Reed is therefore either the executive branch or the judiciary branch, and her service as a special prosecutor is unconstitutional,” the motion said. Accordingly, she is not allowed to continue in office because New Mexico law prohibits a representative from acting as a state attorney at the same time.

If convicted, Alec faces a five-year prison sentence – an unimaginable experience for himself and his family. “Alec is stunned and absolutely devastated  They can’t even imagine this scenario and they tell each other there’s no way this can happen,” a source told UsWeekly.
