The state of Texas will kill Gary Green and Arthur Brown Jr. this week.
Both men’s intellectual disability has been a cause of concern for their legal counsel. The defence in Brown’s case claims that the state withheld evidence that could have led to his dismissal for nearly 30 years.
In 2023 Texas has already killed three people: Robert Fratta Wesley Ruiz and John Balentine.
Five more killings are expected before the end of the year. Henry Skinner whose execution was also set for September died last month as a result of surgical complications.
This marks an increase over the state’s total of five murders in 2022 but the three years with only five executions were an outlier.

Green’s situation has been discussed for years. During his trial however they were unable to show that the crimes were done as a result of his mental illness.
Green’s attorney is attempting to halt the execution due to his client’s intellectual disability and previous mental disorder.
Gary Green 51 will be executed by lethal injection at the Huntsville state jail.
In 2010 he was sentenced to execution for stabbing his wife Lovetta Armstead and drowning her 6-year-old daughter Jazzmen Montgomery at their Dallas Texas home on September 21 2009.
If Green’s execution is carried out he will be the fourth prisoner killed in Texas this year.
On January 10 and February 1, the state executed Wesley Ruiz John Balentine and Robert Fratta.
Arthur Brown Jr. will be shot in Texas on Thursday and Anibal Canales Jr. will be executed on March 29.
Green’s defence attorney stated that the crimes were the result of his mental illness.
When he contacted the police he allegedly stated that he had heard voices and believed Armstead and her children were planning an attack on him.
These claims supported his use of a mental defence in pleading not guilty. However, after being found culpable the judge executed him. Green was prescribed medication for schizophrenia and depression after spending four days in a mental hospital just one month before the murders.
He used to be able to buy it but not any longer. Given his history of mental disorder, his lawyer argues that he should not be executed.
The Green case raises critical issues about the relationship between mental illness and the death penalty.
Despite the defence lawyers’ claims that their client’s mental illness motivated him to conduct the crimes the court found him guilty and sentenced him to death.
His attorney on the other hand is attempting to halt the execution by bringing up his intellectual disability and past mental illness.
As the debate over mental illness and the death sentence persists Green’s case serves as an important example of this complex issue.

According to a 2010 Dallas Morning News article Armstead was assassinated shortly after informing Green that she wished to divorce him.
Green received a note from Armstead asking him to leave their house on the day of the murders. He responded by saying that Armstead her three children and himself would be “carried away” that day.
Armstead’s sons who were 9 and 12 years old at the time allegedly testified in Green’s trial that their stepfather forced them to look at the corpses of their murdered mother and sister. This was mentioned in the newspaper.
Green stabbed the younger sibling in the abdomen when he gathered up the younger sibling from church that day while holding them at knifepoint.
They stated that they were successful in convincing Green not to kill them. The elder son testified that after seeing the bodies Green told them he was going to commit suicide and told them not to contact the police until he was gone.
